apreching and passing 109 traffic slows again south towards 370 and spotty delays in rockville headed for the split. that's a check of your fox 5 on time traffic. >> thank you very much. we begin this morning in boston where officials say the flu out break is so bad, they've declared a public health emergency. so far, 18 people have died from flu related illnesses. four of those have been in boston. massachusetts isn't alone in the fight against the flu. 41 states have widespread out breaks. in maryland, health officials have confirmed more than 2300 cases of the flu. this year's strain hit earlier and harder. some experts predict it could be the worst flu season in a decade. increased 10 to 20% already. and the rate for children's visits have jumped even higher. the good news is it's not too late to get a flu shot.

former penn state football coach jerry sandusky will be back in a pennsylvania courtroom asking for a retrial. comes about 6 months after a jury convicted him on dozens of accounts of child molestation. for more on today's hearing we turn to bruce gordon live in pennsylvania this morning. good morning. >> reporter: good morning, allison. yeah, from the very beginning, jerry sandusky's lead defense attorney made this point: in the court of public opinion, jerry sandusky was convicted the day he was arrested. but in this court hearing this morning set around 9:30, they will be making a case and asking for a trial that this was a literal rush to judgment. it was fast. jerry sandusky was arrested november 5th, 2011 and

219 days later, he entered a courtroom for trial. involved dozens of child molestation charges. two of the accusers unnamed and unknown. at his october sentencing, joe amandola said mountains of information poured in. >> we needed more time to go through that information. and we ran out of time. we had to cut off our investigation to get ready to go to trial. >> the far less complicated perjury case against penn state officials around the same time, still hasn't gone to trial. prosecutors dismissed the claims accusing him of wasting time. >> i understand they must devote a certain amount of time to the media. >> knows public sympathy for a child predator is next to zero.

but during a legal seminar just days after sentencing, he told me there's a bigger issue. i know many people think jerry sandusky is guilty. that's not the issue. the issue is and always been, jerry sandusky like you and me and everyone else is entight manied to have ample time to prepare his defense. >> at that same seminar, his appeal is the longest of long shots. >> what judge wants to give jerry sandusky a new trial? >> two hours of testimony to make their case and jerry sandusky himself is expected to be in the courtroom. it will be a chance to see the physical toll of more than 6 months in a prison cell on a 68-year-old man. >> reporter: that hearing expected to get underway at 9:30 this morning. and we do expect to see jerry sandusky in a courtroom. and also expect to

process with rgiii how it's going to workout from this point. >> today is a difficult day because of the pain he's having. in a way it's a good day. it's the beginning of his eventual return. his leg elevated with the use of crutches. partial weightbearing. the trainers will work with him to restore his range of motion. and that's going to take probably 8 weeks to get his motion back. i would guess he'll be immobilized for a short period of time. 3 to 6 weeks. healing up of the lateral collateral ligament. that structure usually takes a period of relative immaterial.

in terms of ultimate return to agility drills. and then back to the field activities. >> now, is it reasonable or unreasonable to expect he could be done with this and ready to go by the start of football season 6 to 8 weeks. is that reasonable? >> i suspect you mean 6 to 8 months. >> i'm sorry. you are absolutely right . >> you know, the fact is that i appreciate the enthusiasm and the hopefulness and we always do everything we can. he's a dedicated athlete and going to be diligent and is quite motivated. nobody is going to do a greater job in physical therapy and they have the most talented therapists in terms of andrew's program and with the redskins. having said that, there are limitations to hit all your milestones to restore your motion and strength. and the ability to pivot and cut.

long way of saying to you i think a 9 month timetable is realistic. would i expect him at the beginning of next season? i'd love to see that. i don't know that's realistic. >> what about life after? a lot of people are talking about look what adrian peterson did. what is lifelike typically after? you deal with these athletes. they are not regular people. they are great athletes with great bodies. what is life going to be like for him after? can we see rgiii at top speed or is it going to be a decline? >> it's a great question. the fact is he has so much athletic reserve. he may well return to the same activity. predictably these operations lead to a 90 some percent of success rate. may be slightly lower cause he

had a more complicated surgery. revision of his previously reconstructed acl. and he had an lcl and adds a little to the equation. i'd expect him to be back on the field and performing at a high level and your excellent question, i don't know. that remains to be seen. >> and moving forward, he's had a surgery in college on that knee. he's had this surgery. problems down the road or is it you just can't tell? it just depends on the person or athlete? a lot of times it could be a reoccurring thing. is it a point we just don't know? >> we don't know. it's fair to say. also on other structural injuries. how does his -- how will he recover. once he returns to his previous level of activity, i would expect him to

when cfpb announces later today. former penn state football coach jerry sandusky expected back in a pennsylvania courtroom. focus on whether his defense lawyers had enough time to prepare for his trial. they claim the prosecution overwhelmed them with material. he was convicted of 45 counts of child sex abuse and serving a 30 to 60 year prison sentence. vice president joe biden is scheduled to meet with members of the nra today in light of the administration push of gun reform. asking congress to several revisions of the law including banning military assault rifles and high capacity magazines. met with two survivors of the virginia tech shooting. the obama administration will act quickly to curb gun violence. and northern virginia's congressional delegation will launch a major push to get the fbi to relocate headquarters to the commonwealth. this is

turning into quite the regional battle. local leaders also want the fbi and lobbying hard to move to the home turf bringing with an estimated 12,000 employees. allison. >> thanks, melanie. now to a health alert. robert griffin iii's knee surgery is being called a success. he's expected to stay in florida so he can be monitored and begin the rehabilitation process. he had his torn lcl repaired and a revision of the acl construction. estimated recovery time 6 to 8 months. we talked with dr. ben shaffer about his road to recovery and what it's going to take him to be ready for next season. >> i would guess that he'll be immobilized for a short period of time 3 to 6 weeks. that will

be in deference. they'll work on strengthening the knee and normal quads and hamstring function and ultimate return to agility drills and back to the fields activities. >> so amazing he played on that hurt knee. we wish him well. griffin's rehab would have to be picture perfect in 6 to 8 months and 9 months will be more realistic for his return. >> a maryland day care is closed this morning after one of its employees was arrested for abusing a small child. 19-year-old jonathan cummings admitted he kicked a 2 year old boy last friday. we're told an on a celld at the day care phone. the day care is unlicensed. neighbors believe as many as 30 to 40 children were cared for there. >> he needed the proper

training. how do you have a 19-year-old to monitor 40 children? that's impossible. >> police believe there may be other victims. they are asking anyone with information to contact them. and they of course can remain anonymous. a decision from dc's attorney general on whether to charge meet the press host david gregory could come by the end of the week. held up a high powered empty magazine on air while interviewing an nra representative. possession of that magazine is against the law in dc. if charged, gregory faces up to one year in jail and a $1,000 fine. neither nbc nor gregory has commented on the issue. >> the design for the chuck brown memorial and sign legislation that finalizes the honor.

welcome back at 8:11. now to a health alert impacting the entire nation. we're talking about the flu. you can see on the map beside me all those states in red. 41 of them is where the flu is widespread. it's causing health officials to

take drastic action in our area and across the nation. >> in maryland more than 2300 people are already diagnosed with flu. visits to the pediatric emergency room at shady grove hospital are up 25%. and adult visits have spiked between 10 and 20%. to virginia where more than two dozen medical centers are asking all patients and visitors to wear masks in order to stop the spread of the flu. up in massachusetts, the flu situation is so bad in boston, the city has declared a public health emergency. 700 confirmed cases there compared to just 70 last season. and taking no chances in philadelphia, at least one hospital trying to prevent more infections by setting up a flu triage tent outside in order to keep flu patients away from healthier folks. >> health officials say some flu cases can sometimes last as long

as april or may. so there's still plenty of time to get the flu vaccine which is proving very affective against this year's sprain against the illness. serious out there. >> it's a little scary, allison. i guess i have to get my flu shot today. we are learning of more changes to president obama's cabinet. hilda solece has submitted. she made the decision after discussing it with family and friends. one of the highest rafrpging hispanics in the cabinet. picking his chief of staff to lead the treasury department. would replace tim geithner. if lou does become treasury secretary, his loopy signature could grace the dollar bill. not that you'll be able to read it. it does kind of start off with a j and followed by 7

wrap yourself around the beltway. slowing out of austin hill and from allen town road over towards 295. 32 minute drive and that's with lanes open. westbound 4 at the parkway tying up the left lane. 295 before the inbound 11th street bridge. let's pull up those cameras and show you what's happening. across the american legion bridge, heavy volume on the outer and inner loop. lanes here are open. southbound 270 still on the brakes. and 395 from the beltway trying to get past duke street, heavy and slow. that's a check of your fox 5 on time traffic. >> julie, thank you. they can be found all around the globe and maybe aeven in your own communities. adult predators who exploit children. abusing them and sharing images of that abuse with other predators. an international effort is underway to pursue these predators and may be able to bring some of

them to justice. joining us now is john torres, the special agent in charge of the immigration and custom enforcement homeland security investigations. good morning to you. >> good morning, allison. >> tell us about this initiative. it is fairly new and the ultimate goal of course. >> right. the recent initiative operation sunflower we started last november is more of a victim based approach with priorities. so we're trying to focus more on crimes that have an impact on victims, especially children. >> immigration is involved because the internet is just this vast sort of unknown territory. and we've been using it for a while now. still no boarders on the internet. it's global. the worldwide web. ice is called in to help maybe secure some of those boarders. >> that's right. one of our focuses at homeland security investigations within ice is to

focus on all boarders whether it's an air boarder, land boarder or in this instance specifically a virtual boarder. and as you say, there are no boarders but a number of these crimes originate overseas and a number of these crimes cross boarders. >> and you are able to get the source of where some of these images are coming from and the abuse is happening. >> that's exactly right. in one of the cases here out of northern virginia, there was a firefighter where we intercepted messages of sexually explicit nature with a 15-year-old girl he was in contact with over in canada. we arrested him and he is now serving 10 years. >> what other sort of success recently have you had? more local cases but perhaps originate or the image shows up in sweden and comes from

someplace in michigan. what other kind of efforts like that have you seen? >> a number of things we have going on. not only do we have offices in every state but offices in 47 countries around the world. and that really enables us to work with foreign law enforcement partners whether it's through a virtual global task force. we are able to work internationally and some instances we see leads out of russia or eastern europe. and then we understand in prioritizing we want to focus on people that have access to children. people that are in a position of public trust. school teachers, police officers, firefighters, et cetera. so we're able to work cases numbers wise in the past year over 1600 people we've arrested. including 38 in this area. >> let's talk more about this area before we talk about how folks can get involved. can you share any other successes here in our area? >> it is a success story.

unfortunately it involves a teacher in fairfax county who was collecting child pornography. a teacher who works with our young children. for those reasons and this was in alexandria. we want to focus on people in a position of public trust. there was another case out of our hampton roads office where we had a person who was producing child pornography. and he would take those pictures and share them on a peer to peer network on the computer. so he would share the images he produced and obtain and exchange images someone else produced. >> we go about our daily lives and don't ever have cause to see some of the ugliness you see and deal with all the time. but this is happening right now. and it's organized and through the efforts of ice and homeland

security, you're trying to crack down on this reality. what are we seeing here? >> we have a number of cases. we're seeing a growing trend mostly because we are applying more resources to it. we have a number of cases here in northern virginia. we have another outstanding 80 cases at this time. the number of leads are really shocking. in other offices i've worked at we've been able to break them down county by county and because the leads are so substantial we have to prioritize those leads and say go with the worst of the worst. >> how do we get involved? if you are watching and want to help, how do you get involved? >> you can contact us with the leads. on our web site available a tip line 888 dhs-2 ice. more importantly, as a parent, pay attention with social media and the access younger children now have to be

wanting to go to bed. it is a common thing parents struggle with. >> how would you know it's something that needs expert attention? >> i think that if you get to the point with your children where bedtime is becoming a battle time. where people are getting upset and raises voices and the child is not able to go to sleep or stay asleep or neither one of you is sleeping, that's the time you want to talk to your pediatrician. take a look and try to figure out what's going on with the child. and what might be at the root of the sleep problems. and can really help you get to the bottom of them. >> a lot of parents are getting by on 6 or 7 hours. but how much do they really need? >> well, most kids are going to need 10 hours a sleep a night. 4 or younger they may need up to 12 hours. and as we become teenagers, they need less and less. you have to kind of figure out how is your child

doing during the waking hour on whether they are having struggles. a lot of kids may be showing attention deficit problems during the daytime. they have difficulty focusing in school. maybe acting up in school. not because they want to but because they are so tired, they don't know how to express themselves. so this is really something that needs to be paid attention to. really critical is especially if you have younger ones, getting into a sleep routine. you go to the bed at the same time and get up at the same time. even on the weekendses. no real sleeping in on the weekends. and putting into affect these calm down periods. sleep is not an on and off switch. you can't flick off a switch and the little one goes to sleep. if you are a parent you know what i'm talking about. taking away the electronic gadgets. reading with your child. helping your child get into that relaxed mode so they can go to sleep and that should start an hour before bedtime. >> all right.
